Terms and conditions

1. General

These terms and conditions together with our privacy policy, our cookie policy, specific instructions on the Delivery, Returns and Payment pages, and any additional terms and conditions and information that may be provided to you for ordering products are applicable to all purchases made from our online shop.

BY PLACING AN ORDER FOR PRODUCTS IN THE ONLINE SHOP AND CHECKING THE BOX TO ACCEPT THE TERMS AT THE CHECKOUT STAGE, YOU AGREE TO THESE TERMS. If you refuse to accept them, you will not be able to order products from our site.

We reserve the right to make changes to these terms and conditions at any time. Whenever you order products from us, the terms and conditions in force at the time of your order will apply to the contract between you and Collection Privée.

We shall also have the right, without notice or compensation, to restrict or withdraw access to the Online Shop, to remove items from the Online Shop or to restrict the use of certain features and services of the Online Shop, in whole or in part.

These conditions do not affect your statutory rights, which cannot be waived or limited by contract.

2. Orders

You may place an order and purchase Products from the online shop if you meet the following conditions

you are at least 18 years old;

you are the owner or authorised holder of a valid debit/credit card to pay for your purchases 

you agree to provide your real name and correct and complete address, telephone number, email address, payment details and other required information.

Our shopping pages will guide you through the steps to place an order on the Private Collection website. Our ordering process allows you to check and correct any errors before submitting your order. Please take the time to read and check your order on each page of the ordering process.

The 'confirmation' stage shows the final details of your order. Following this, we will send you an email acknowledging receipt of your order and detailing the products you have ordered ("Order Confirmation"). However, please note that this does not mean that your order has been accepted. Acceptance of your order and the conclusion of the contract between you and us will occur when the goods ordered are dispatched to you, at which time we will send you an order dispatch confirmation email. We may choose not to accept orders for any reason or no reason at all. If we are unable to accept your order, we will inform you in writing and will not charge you for the product. This may be because of unexpected limitations on our resources that we could not reasonably foresee, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline. 

2.1 Pre-orders

If a painting is no longer in stock or if you wish to order several of the same paintings but the desired quantities are no longer available, pre-ordering is required.

Please note that a painting is not a manufactured product, it is unique. Therefore, we do not have large quantities available for each model presented. 

The artists need a reasonable time to produce the works, about 2 months.

If you wish to order a painting that is no longer in stock, you can order it by indicating the desired quantity, then clicking on "add to basket" and paying the requested price. The pre-ordered product will be delivered within 2 months.

Please take this into account when ordering.

3. Price and payment

3.1. Prices and other charges

Unless otherwise stated, the prices displayed for products on the Online Shop represent the full retail price indicated on the product itself in effect at the time of your order. These prices include value added tax or other taxes applicable for the European Union (EU) Member State where the order is placed. The amount of value added tax will appear during the ordering process after you have indicated the country of your billing and delivery address. Prices include delivery and processing costs.

Our online shop supports certain currencies. When we take payment for an order in the currencies supported by our webshop, we are not responsible for the exchange rate at which a bank charges its customer, nor for any additional fees it charges. In addition, any refund will be made in the same currency as the order was placed.

If an error is discovered in the price of the products you have ordered, we will contact you before accepting your order. If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognised as a pricing error, we may refund any money you have paid and require the return of any goods supplied to you.

Prices quoted in the web shop apply only to online purchases from this web shop and we do not guarantee the same prices in third party shops. We reserve the right to change prices and payment terms at any time without notice. These changes will not affect orders already placed.

3.2 Additional charges on deliveries outside the EU

If your order is placed outside of the European Union, any applicable duties, import fees, taxes and other charges are your responsibility. You agree and acknowledge that payment in full of such fees, taxes or charges may be required to clear the goods ordered from customs upon arrival. The Seller will not assess or collect any of the above fees, taxes or charges.

For deliveries outside the EU, the final price of the products will be displayed in the shopping cart page. For deliveries outside the EU, the applicable VAT will be 0%. The applicable price of the Products is displayed on the checkout page before payment is made.

3.3 Payment methods

We only accept payment by debit/credit card. Please see the payment methods.

When placing your order, you will need to provide details of your chosen payment method and authorise payment via your bank or other payment service provider. Unless otherwise stated in Payments, when you place your order we will ask your card issuer or other payment service provider to place a provision of funds on your card or other chosen payment method. The payment method you have chosen will be permanently debited when your order is dispatched. We will not dispatch the goods ordered to you until your card issuer or other payment service provider has authorised the use of your chosen payment method for those purchases. Please note that payments made via online banking (where available) will be charged immediately.

We may use third party providers to process your payment, in which case you will be redirected to the pages of those third party providers. Please note that any processing of personal data by a third party supplier will be governed by that third party supplier's own privacy policy.

Please note that we reserve the right to cancel your order without notice if your chosen payment method cannot be processed.

4. Delivery

The Products will be sent to the delivery address you have indicated in your order and as set out in the Order Confirmation.

Estimated delivery dates are set out in the Order Confirmation.

The title of the Products you have ordered on this site will be passed to you at the time the chosen method of payment is invoiced. Risk in the products will pass to you on delivery, assuming we have received full payment for the product.

We encourage you to examine the delivery package and the products received upon delivery of your package. And to check that the delivered order is complete and that the Products are in good condition. If the Products have been damaged in transit, please report this to the carrier and provide us with proof.

We shall not be liable for any delay or failure to perform if the delay or failure to perform is caused by circumstances beyond our control (i.e. force majeure). We will take all reasonable steps to prevent and minimise delays caused by such circumstances. In the unlikely event of a significant delay, you will have the right to cancel your order at no extra cost.

However, if for any reason we are unable to deliver your order within thirty (30) days of placing it, and it is not a pre-order, we will inform you as soon as possible and you will be entitled to a full refund in accordance with the method of payment you used.

5. Order cancellations, returns and refunds

For further details on returns, please see our Returns Instructions from the "Delivery and Conditions" which form part of these Terms.

Please note that we will only process returns, replacements and refunds for products purchased from this online shop. If you purchased our products from another online shop or distribution channel, please follow the applicable vendor's return policy.

All refunds will be made by crediting the payment card originally used for the original purchase, unless explicitly agreed otherwise in writing.

5.1 Cancelling and returning your order

For all products ordered from the online shop, you have a right of return and refund during a cooling-off period.

All products must be returned unused and in their original packaging. To ensure that your return is processed correctly and as quickly as possible, please contact customer service to provide you with the necessary paperwork to complete the return. 

To the extent permitted by applicable law, we will reduce your refund to reflect any reduction in the value of the products, if this has been caused by your handling in an unauthorised manner.

Please note that we will not refund the cost of return except in the case of a defective product or defective delivery. In other cases, a refund of the return shipping costs will only be made if required by the respective applicable law or otherwise indicated by us at Delivery and Returns.

Please note that for all returns of orders placed outside the EU, only the price paid in the online shop will be refunded, and Collection Privée will not refund any taxes, fees or other charges applied to the order by your country of residence, customs or authorities.

5.2 Returns of defective Products and returns due to defective deliveries

You have a legal right to expect to receive goods that conform to the product description for the purpose stated. We must provide you with goods that comply with your legal rights set out above. If the Goods do not comply with these, the product may be considered defective.

If the Product(s) delivered to you are faulty or do not match the items you ordered, please contact our customer service department collectionprivee.illustration@gmail.com. Please note that you will need to provide us with clear photographic evidence of the alleged fault or damage.

Where the Products have been damaged in transit, you must report this to the carrier on delivery. This proof will be requested by customer services in order to proceed with a replacement or refund.

Replacements are only possible if we have the items in stock, otherwise you will be refunded.

Please note that we will not refund any return delivery charges you have paid, unless we confirm this in writing.

5.3 Return shipping costs

When you exercise your right of withdrawal, the cost of return shipping, as well as any taxes and customs duties incurred in returning the package, will be deducted from your refund. 

5.4 Our right to cancel your order

We have the right to cancel the contract with you if the method of payment you have chosen cannot be charged or if we cannot deliver the goods ordered to you for reasons within your control.

6. Personal data

Any use of your personal data in the online shop is governed by our privacy policy.

7. Limitation of liability

Please note that the actual colours you see on your computer may vary depending on the monitor you use.

Except for any legal liability that we cannot exclude at law (such as for death or personal injury) or under applicable laws relating to the protection of your personal information, we are not legally responsible for any losses that :

were not foreseeable by you and us at the time the contract was formed (for example, technical problems) ;

which were not caused by a failure on our part 

commercial losses

losses to non-consumers.

8. Changes to these Terms and Conditions and Severability

All changes to these Terms of Sale shall become effective on the Effective Date, as indicated at the beginning of these Terms of Sale. 

If any provision of these Terms is held to be invalid, illegal or unenforceable, that provision shall be enforced to the fullest extent permitted by the respective applicable law. This shall not affect the validity, legality and enforceability of the remaining provisions.

9. Applicable law 

These Terms shall be governed by and construed in accordance with the laws of the country in which the Seller is established. The courts of the country and city where the Seller is established shall have non-exclusive jurisdiction in respect of these Terms.

As a consumer, you will benefit from all mandatory provisions of the law of the country in which you reside. Nothing in these Terms and Conditions affects your rights as a consumer to rely on such mandatory provisions of local law.

We will try to resolve any dispute with you directly. If you and we cannot resolve a dispute using our internal complaints procedure, you can also use the online dispute resolution platform.
